Terms of Service
Effective October 23, 2026
These terms are an agreement between you and Sulphanic LLC (“Sulphanic”, “we”, “us”), a New Jersey limited liability company, for your use of the Instead: Stop Scrolling app (“Instead” or “the app”) and doitinstead.com. By using Instead, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the app.
1. What Instead is
Instead helps you spend less time scrolling. It locks the apps you choose until you do one quick real-world activity, such as a short walk, a timer or a photo of something around you, and then opens them for a while. Instead is a self-help tool. It isn't medical, mental-health or professional advice, and it isn't a parental-control or security product.
2. Who can use it
You must be at least 13 years old, and old enough to agree to these terms where you live (or have a parent or guardian agree for you). You're responsible for how Instead is used on your device.
3. Your account
An account is optional. If you sign in, keep access to your Apple or Google account secure; you're responsible for activity under your account. You can delete your account in the app at any time.
4. Activities and your safety
Activities are suggestions. Only do what's safe and comfortable for you, pay attention to your surroundings (especially when walking), follow local laws, and respect other people's privacy when taking photos. Never use your phone in a way that's unsafe, for example while driving. If you have a health condition, check with a professional before starting any physical activity. You do activities at your own risk.
5. How locking works, and its limits
Instead relies on Apple's Screen Time features. Locks can stop working or behave differently because of iOS updates, device settings, Screen Time permissions, Low Power Mode or other things outside our control, and you can turn them off in your phone's Settings at any time. Don't rely on Instead to block access to anything where a failure could cause harm. Activity checks (steps, timers, photo recognition) are automated and can make mistakes in either direction.
6. Purchases
- Instead Pro is an auto-renewing subscription, sold monthly or yearly. If a free trial is offered, it turns into a paid subscription when it ends unless you cancel at least 24 hours before. Payment is charged to your Apple Account. The subscription renews automatically at the same length and price unless you cancel at least 24 hours before the end of the current period. You can manage or cancel it in your Apple Account settings (Settings → your name → Subscriptions). Cancelling stops the next renewal; you keep Pro until the end of the period you've paid for.
- Rays are an in-app item used to open locked apps early. Rays have no cash value, can't be transferred or exchanged for money, and are only used inside Instead. Purchased Rays are used up when spent.
- Prices are shown in the app before you buy and may change; a price change for a subscription follows Apple's rules and notices.
- All purchases are processed by Apple. Refunds are handled by Apple under its policies (reportaproblem.apple.com); we can't issue refunds directly.
7. Acceptable use
Don't misuse Instead: don't try to break, overload or get around its security, reverse-engineer it except where the law allows, use it to break the law, or interfere with other people's use of it.
8. Our app and content
Instead, its design, text, graphics and code belong to Sulphanic or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, under these terms and Apple's Usage Rules. Photos you take stay on your phone and remain yours. If you send us feedback, we may use it without any obligation to you.
9. Changes and ending
We may update, change or stop parts of Instead. We may suspend or end your access if you seriously or repeatedly break these terms. You can stop using Instead at any time by deleting the app and, if you have one, your account. Sections 6 (as to purchases already made), 8, 10, 11, 12 and 13 continue after these terms end.
10. Disclaimers
To the extent the law allows, Instead is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that Instead will be uninterrupted, error-free, or that it will change your habits.
11. Limitation of liability
To the extent the law allows, Sulphanic won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or opportunities, arising from your use of Instead. Our total liability for any claim relating to Instead is limited to the greater of the amount you paid us for Instead in the 12 months before the claim and US$50. Some places don't allow these limits, so they may not apply to you, and nothing in these terms limits rights you have under consumer law that can't be waived.
12. Indemnity
To the extent the law allows, you agree to cover Sulphanic's reasonable losses and costs from claims caused by your breach of these terms or your misuse of Instead.
13. Governing law and disputes
These terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-laws rules. Before filing a claim, please contact us at support@doitinstead.com so we can try to resolve it informally. Any dispute that isn't resolved will be heard in the state or federal courts located in New Jersey, and you and we consent to their jurisdiction, except that either of us may bring a claim in small-claims court. If you're a consumer in a country that gives you the right to bring claims in your local courts or under your local law, these terms don't take that right away.
14. Apple
These terms are between you and Sulphanic, not Apple. Apple isn't responsible for Instead or its content, and has no obligation to provide maintenance or support for it. If Instead fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the extent the law allows, Apple has no other warranty obligation. Apple isn't responsible for any claims relating to Instead, including product liability, legal or regulatory claims, or consumer-protection claims; Sulphanic, not Apple, is responsible for investigating and resolving any claim that Instead infringes someone's intellectual property. You confirm that you aren't located in a country subject to a US government embargo or on any US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Where these terms and Apple's Licensed Application End User License Agreement differ on something these terms don't cover, Apple's agreement applies.
15. General
If any part of these terms can't be enforced, the rest still applies. If we don't enforce a term right away, we haven't waived it. You can't transfer these terms; we may transfer them as part of a merger or sale of our business. These terms, with the Privacy Policy, are the whole agreement about Instead. If we change them in a significant way, we'll update the date at the top and let you know in the app; continuing to use Instead after that means you accept the new terms.
